"وإن كان ضمنها بالدفع إلى المرتهن فالراهن يأخذ" "القيمة منه" ؛ لأن العين لو كانت قائمة في يده يأخذها إذا أدى الدين، فكذلك يأخذ ما قام مقامها، ولا جمع فيه بين البدل والمبدل.
