وَكَذَا إِذا غزله الْمُرْتَهن لَا يَنْعَزِل وَإِن مَاتَ الرَّاهِن لم يَنْعَزِل

"وكذا إذا عزله المرتهن لا ينعزل؛ لأنه لم يوكله وإنما وكله غيره وإن مات الراهن لم ينعزل" ؛ لأن الرهن لا يبطل بموته ولأنه لو بطل إنما يبطل لحق الورثة وحق المرتهن مقدم.
