"ولو رش فناء حانوت بإذن صاحبه فضمان ما عطب على الآمر استحسانا. وإذا استأجر أجيرا ليبني له في فناء حانوته فتعقل به إنسان بعد فراغه فمات يجب الضمان على الآمر استحسانا، ولو كان أمره بالبناء في وسط الطريق فالضمان على الأجير" لفساد الأمر.
