قال: "وقبول الوصية بعد الموت فإن قبلها الموصى له حال الحياة أو ردها فذلك باطل" لأن أوان ثبوت حكمه بعد الموت لتعلقه به فلا يعتبر قبله كما لا يعتبر قبل العقد.
