باب الوصية بثلث المال] قال: "ومن أوصى لرجل بثلث ماله ولآخر بثلث ماله ولم تجز الورثة فالثلث بينهما" لأنه يضيق الثلث عن حقهما إذ لا يزاد عليه عند عدم الإجازة على ما تقدم وقد تساويا في سبب الاستحقاق فيستويان في الاستحقاق، والمحل يقبل الشركة فيكون بينهما
