"وإن أوصى لأحدهما بالثلث وللآخر بالسدس فالثلث بينهما أثلاثا" لأن كل واحد منها يدلي بسبب صحيح وضاق الثلث عن حقيهما فيقتسمانه على قدر حقيهما كما في أصحاب الديون فيجعل الأقل سهما والأكثر سهمين فصار ثلاثة أسهم: سهم لصاحب الأقل وسهمان لصاحب الأكثر
