قال: "ولو أوصى بذلك لقوم مسمين فهو الثلث" معناه إذا أوصى أن تبنى داره بيعة أو كنيسة فهو جائز من الثلث لأن الوصية فيها معنى الاستخلاف ومعنى التمليك، وله ولاية ذلك فأمكن تصحيحه على اعتبار المعنيين.
