(ولا ينفسخُ) العقد (بنفس التَّحالفِ) لأنه عقد صحيح، فلم ينفسخ باختلافهما وتعارضهما في الحجة، كما لو أقام كل منهما بينة. (ولا) ينفسخ أيضًا (بإباءِ كلِّ واحد منهما الأخذَ بما قال صاحبه) بل لا بُدَّ من تصريح أحدهما بالفسخ.
