(وإلا) أي: وإن لم يرضَ أحدُهما بقول صاحبه (فلكلٍّ منهما الفسخُ بلا حاكم) أي: لا يفتقر الفسخ لحكم حاكم؛ لأنه فسخٌ لاستدراك الظلامة، أشبه ردَّ المعيب.
