(وإن كان) الثمن (دينًا حالًّا، فنصُّه (١) : لا يحبس) البائع (المبيع على قَبْضِ ثمنه) لأن حق المشتري تعلَّق بعين المبيع، وحق البائع تعلَّق بالذِّمة؛ فوجب تقديم ما تعلق بالعين، كتقديم حق المرتهن على سائر الغرماء
