(ومن امتنع منهما) أي: من البائع والمشتري (من تسليم ما) عقدا (عليه) من مبيع، أو ثمن (مع إمكانه) تسليمه (حتى تَلِفَ، ضمنه، كغاصب) لتعديه بمنعه، وأيهما بدأ بالتسليم أجبر الآخر.
