(والمبيع بصفةٍ) معينًا كان أو في الذِّمة (أو) بـ (رؤية سابقة) بزمن لا يتغير فيه المبيع غالبًا (من ضمان البائع حتى يقبضه مُشترٍ) لأنه تعلَّق به حق توفيةٍ، فأشبه المبيع بكيل أو نحوه.
