(ولمن اشترى) المبيع بغير كيل ونحوه (منه) أي: من مشتريه قبلَ قَبضه (المطالبةُ بتقبيضه من شاء، عن البائع الأول) لأن عين ماله بيده (أو) البائع (الثاني) لأن عليه تسليم المبيع لمشتريه.
