(ولو غصب البائعُ الثمن) غير المعين (أو أخذه بلا إذن) المشتري (لم يكن قبضًا) لأنه غصب؛ لأن حقه لم يتعين في هذا بعينه (إلا مع المقاصة) بأن أتلفه، أو تلف بيده، وكان موافقًا لما له على المشتري نوعًا وقدرًا، فيتساقطان.
