(وكذا) يجوز له أخْذ الأرْش (بعدَه) أي: بعد المجلس (إن جعلاه) أى: الأرْش (من غير جنس الثمن) أي: النقدين، كبُرٍّ أو شعير؛ لأنه لا يُعتبر قبضه فيه إذا بيع بنَقْدٍ
