(و) لا يدخل في بيع دار وأرض (معدن جار، وماء نبع في بئر أو عين) لما تقدم في البيع (لا نفس البئر وأرض العين ونحوه، مما يتَّصل بها (فإنه لمالك الأرض) وينتقل بانتقالها؛ لاتصاله بها.
