(فإن اشترطه فهو له، قصيلًا (١) كان أو ذا حبٍّ، مستترًا أو ظاهرًا، معلومًا أو مجهولًا) لأنه بالشرط يدخل تبعًا للأرض؛ فهو كأساسات الحيطان (ويأخذه بائع) ونحوه (أول وقت أخذه، ولو كان بقاؤه أنفع له) كالثمرة.
