(ولو اشترط أحدهما) أي: المعطي أو الآخذ (جزءًا من الثمرة) مُشاعًا (معلومًا) كنصف أو ربع (صحَّ) الاشتراط (فيه) أي: في الجزء المشروط (كاشتراط) من ليست الثمرة له (جميعها، فمن اشترطها) أي: الثمرة
