(فإن اختلفا) أي: المتعاقدان (هل بدا) الثمرُ، أو تشقق الطَّلعُ (قبل بيع) ونحوه (أو بعده، فقول بائع) ونحوه: أنه بعد العقد؛ لأنه ينكر خروجه عن ملكه، والأصل عدمه.
