(فإن لم يعلم قَدْرها) أي: قَدْر الثمرة الحادثة (اصطلحا) أي: البائع والمشتري على الثمرة؛ لدعاء الحاجة لذلك، إذ لا طريق لمعرفة حق كل منهما (والبيع صحيح) فلا يبطل بالاختلاط، كما تقدم في اختلاط الحنطة المبيعة بغيرها.
