(وإن تعيَّبت) الثمرة (بها) أي: بالجائحة المذكورة (من غير تَلَفٍ، خُيِّر) المشتري (بين إمضاء) البيع (مع) أخذ (أرش) العيب (وبين ردٍّ وأخذ الثمن كاملًا) لأن ما ضمن تلفه بسبب في وقتٍ، كان ضمان تعيبه فيه بذلك أَولى.
