(وإن لم يكن في قبضه) أي: المسلم فيه (ضرر ولا يتغيَّر) أي: يختلف (قديمه وحديثه كالحديد والرصاص، والزيت، والعسل ونحوها، لزمه قبضه) لأن الغرض حاصل مع زيادة تعجيل المنفعة، فجرى مجرى زيادة الصفة.
