(لا) يصح عقد السَّلَم (بما في ذمته) أي: المسلَم إليه، بأن يكون له عليه دَيْن فيجعله رأس مال سَلَم؛ لأنه بيع دين بدَيْن، فهو داخل تحت النهي، وتقدم .
