كشاف القناعal-Buhuti

(وهو) أي: القرض (عقدٌ لازم في حق المُقرِض) بالقبض؛ لكونه أزال ملكه عنه بعِوض من غير خيار؛ فأشبه البيع (جائز في حقِّ المقترض) في الجملة؛ لأن الحقَّ له فيه.
