(فإن رهن عينًا يظنها لغيره، نحو أن يرهن عبد أبيه، فيتبين أنه) أي: أباه (قد مات وصار العبد ملكه بالميراث) أو أنه كان أذن له (صح) الرهن كما تقدم في البيع؛ إذ العبرة في المعاملات بما في نفس الأمر.
