(وليس له) أي: للمُرتَهِن، أو وكيله (قبضه) أي: الرهن (إلا بإذن الراهن) لأنه له قبل القبض، فلا يملك المُرتَهِن إسقاط حقه بغير إذنه كالموهوب.
