(وإن كان عليه) أي: الميت (دين سواه، فليس للورثة تخصيص المُرتَهِن بالرهن) لأن حقوق الغرماء تعلَّقت بالتَّرِكة قبل لزوم حقه، فلم يجز تخصيصه به بغير رضاهم.
