(وإن امتنعا) أي: المتراهنان من قبض الرهن من العدل (ولم يجد) العدل (حاكمًا) أهلًا (فتركه) العدل (عند عدلٍ آخر، لم يضمن) أحدٌ منهما الرهن للعُذر.
