(فإن فضل) عن النفقة (من اللبن شيء باعه المأذون له) من مرتهن أو غيره؛ لقيامه مقام المالك (وإلا) بأن لم يأذن الراهن لأحد في بيعه (باعه الحاكم) لقيامه مقامه، إذ لو تركه لفسد.
