(وإن أنفق) المُرتَهِن (على الرهن بغير إذن راهن مع إمكانه) أي: قُدرته على استئذانه (فـ) هو (متبرِّع، ولو نوى الرجوع) لأنه مفرِّط، حيث لم يستأذن المالك، إذ الرجوع فيه معنى المعاوضة، فافتقر إلى الإذن والرضا، كسائر المعاوضات.
