(وإن استوفاه) أي: استوفى المرتَهِن دَيْنه (من الأرش) الذي أبرأ الراهن الجاني عنه (رجع جانٍ على راهن) لأن ماله ذهب في قضاء دينه، فلزمه غرامته، كما لو استعاره فرهنه.
