(ولو باعها) أي: العين المرهونة (الحاكم ووفَّاه) من ثمنها (جاز) لأن الحاكم له ولاية مال الغائب (ويأتي في) باب (الغصب: لو بقيت في يده غُصوبٌ ونحوها) كعوارٍ أو أمانات (لا يعرف أربابها) فيدفعها إلى الحاكم، أو يبيعها ويتصدق بثمنها.
