(وإن لم ينوِ) الضامن حال القضاء أو الحوالة (رجوعًا ولا تبرُعًا، بل ذَهَل عن قصد الرجوع وعدمه، لم يرجع) الضامن على المضمون عنه بشيء كالمتبرِّع؛ لعدم قصده الرجوع.
