(ولا) تصح الكفالة (إلى أجلٍ مجهول، ولو في ضمان) أي: لا يصح الضمان إلى أجل مجهول (كـ) قوله: ضمنته أو كفلته إلى (مجيء المطر وهبوب الرياح) فلا يصحان (لأنه ليس له وقت يستحقُّ مطالبته فيه) بما ضمنه أو كَفَله.
