(إلا) إذا كَفَلَ بدنه (لأَجْلِ مالٍ بالدفع) أي: بالعفو إلى الدِّية ليدفعها (و) إلا إذا ضمن السارق بسبب (غرم السرقة) أي: المسروق، فتصح؛ لأنه حق مالي.
