(فإن أطلق) كقوله: أنا كفيل ببدن فلان (كانت حالَّةً، كالضمان) إذا أطلق يكون حالًّا (لأن كلَّ عَقْدٍ يدخله الحلول) كالثمن في البيع، والأجرة والصداق (اقتضى إطلاقه الحلول، فإن عيَّن) الكفيل
