(إلا إذا شرط) الكفيل (البراءة منه) أي: من الدَّين، فلا يلزمه، عملًا بشرطه؛ لأنه إِنما التزم الكفالة على هذا الشرط، فلا يلزمه سوى ما اقتضاه التزامه.
