(وإن كَفَلَ) الكفيل (الثاني) شخص (ثالثٌ، برئ كلٌّ منهم) أي: الكفلاء (ببراءة من قبله) لأنه فرعه (ولا عكس) أي لا يبرأ أحدهم ببراءة من بعده؛ لأنه ليس فرعه (كضمان) في مال.
