(وإن صالحه) عن دية الخطأ وقيمة المُتلَف (بعرض قيمته أكثر منها) أي: من دية الخطأ أو قيمة المُتلَف (صح) الصلح (فيهما) أي: في مسألة الدية ومسألة القيمة؛ لأنه لا ربا بين العِوض والمعوَّض، فصح، كما لو باعه ما يساوي خمسة بدرهم.
