وإن صالحه ببعض بيت أقر له به أو على أن يسكنه سنة أو يبني له فوقه غرفة لم يصح

كشاف القناعal-Buhuti

(وإن صالحه) صاحب بيت (ببعض بيت أقرَّ له به) لم يصح الصُّلح؛ لأنه صالحه عن بعض حقه ببعضه (أو) صالحه (على أن يَسْكنه) المقرُّ (سَنَة، أو) صالحه على أن (يبني له) المقرُّ (فوقه) أي: فوق البيت المقرِّ به (غرفة، لم يصح) الصُّلح؛ لأنه صالحه عن ماله على ماله، أو منفعته.
