(وإن أعطاه) أي: أعطى المقَرُّ له المقِرَّ (بعضَ داره بناءً على هذا) الصُّلح، لم يلزم الإعطاءُ؛ لترتُّبه على الصلح الفاسد (فمتى شاء) المقَرُّ له (انتزعه) أي: ما أعطاه له (منه) أي: من المقر.
