(وإن اتفقا) أي: المقِرُّ والمقَرُّ له بالبيت الذي بنيت فوقه الغرفة (على أن يصالحه صاحب البيت على بنائه) الذي هو الغرفة (بعِوض، جاز) الصلح؛ لأن الحق لهما.
