(وإن أراد) الباني بتراب صاحب البيت والآلة (نقض البناء، لم يكن له ذلك) أي: نقض البناء؛ لأنه لا حق له فيه (إذا أبرأه المالك من ضمان ما يتلف به) أي: بالبناء، وتصح البراءة منه، كما يأتي في الغصب.
