(وإن اتفقا على أن يحمِّله) أي: الحائط المشترك بعد بنائهما له (كل واحد منهما) أي: من الشريكين (ما شاء) من بناء أو خشب (لم يجز) الصُّلح (لجهالة الحمل. ولا يُجبر) الشريك
