(فإن توجهت على المفلس يمين) بأن ادعي عليه بشيء فأنكر، فطلب الخصم يمينه (فَنكَل عنها، فقُضي عليه) بالنكول (فكإقراره، يلزم في حقه) فيتبع به بعد فَكِّ الحَجْر عنه (دون الغرماء) فلا يشاركهم للتهمة.
