(وإن تصرَّف) المُفلِس (في ذمته بشراء، أو ضمان، أو إقرار، صح) تصرُّفه (ويتبع به) أي: بما لزمه من ثمن مبيع، أو ضمان، أو إقرار (بعد فَكِّ الحَجْر عنه؛ لأن الحَجْر متعلِّق بماله) لحقِّ الغرماء (لا بذمته) بخلاف السفيه ونحوه
