(وإن بان تلفها) أي: السلعة (حين استرجاعه) لها (بطل رجوعه) أي: تَبَيَّنا أن رجوعه كان باطلًا، إذ لا يمكن الرجوع في المعدوم.
ومنه لو رجع في أَمَة وَطِئها المُفلِس، ثم تبيَّن أنها كانت حملت قبل الرجوع، إذ الاستيلاد إتلاف.
