(فلو لم يوصِ الأبُ إلى أحدٍ) بالصفات المعتبرة، أو كان الأبُ موجودًا غير متصف بالصفات المعتبرة، كما يدلُّ عليه كلامه في الهبة (أقام الحاكم أمينًا في النظر لليتيم) والمجنون؛ لانتقال الولاية إليه.
