(فإن لم يوجد حاكم) بالصفات المعتبرة (فأمينٌ يقوم به) أي: باليتيم. سأل الأثرم الإمام عن رجل مات، وله ورثة صغار، كيف يصنع؟ فقال: إن لم يكن لهم وصي، ولهم أم مشفقة تدفع إليها.
