(وإن شاء) المالك (كان) ما تلف بيد السيد (متعلِّقًا برقبة العبد) لأنه الذي حال بينه وبين ماله، فعلى هذا يخيَّر المالك بين أن يرجع على السيد أو العبد، قاله في "المغني" و"الشرح" و"التلخيص".
